Terms of Service

Welcome to JourneyCatcher! These Terms of Service ("Terms") govern your use of the JourneyCatcher mobile application and related services (collectively, the "Service") operated by Journey Catcher ApS ("we," "us," or "our").

By downloading, accessing, or using JourneyCatcher, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years old (or 16 in some European countries) to use JourneyCatcher. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.

3. Description of the Service

JourneyCatcher is a location-based adventure and scavenger hunt platform that allows users to:

• Play adventures created by other users or our team
• Create and publish their own adventures with locations, riddles, and stories
• Track their progress and achievements
• Explore real-world locations through guided experiences

4. Location Services and Safety

JourneyCatcher requires access to your device's GPS to function. By using the Service, you acknowledge and agree that:

• Physical Safety: You are solely responsible for your physical safety while playing adventures. Always be aware of your surroundings, obey all traffic laws, and do not trespass on private property.
• Weather and Conditions: Do not play adventures in dangerous weather conditions or unsafe environments.
• Distractions: Do not use the app while driving, cycling, or operating machinery. Stop in a safe location before interacting with the app.
• Location Accuracy: GPS accuracy may vary. We are not responsible for location inaccuracies that may lead you to unintended areas.
• Minors: Parents and guardians should supervise minors using the Service.

Journey Catcher ApS is not responsible for any injuries, damages, or losses that occur while using the Service.

5. User-Created Content

You may create and publish adventures, including locations, riddles, hints, stories, and photos ("User Content"). By submitting User Content, you:

• Grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with the Service
• Represent that you own or have the necessary rights to the content you submit
• Agree not to submit content that infringes on any third party's intellectual property rights
• Retain ownership of your User Content

5.1 Content Ownership and Deletion Rights

While you retain ownership and moral rights to your User Content, once published to JourneyCatcher, adventures become part of our content library to ensure continuity for users who may have started or completed your adventures. You may request deletion of your personal information at any time, but published adventures cannot be revoked from the platform.

5.2 Content Guidelines

You agree not to create or submit User Content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Contains sexually explicit material or promotes violence
• Promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age
• Infringes any patent, trademark, copyright, or other proprietary rights
• Directs users to dangerous or private locations
• Contains viruses, malware, or other harmful code
• Violates any applicable local, state, national, or international law

We reserve the right to remove any User Content that violates these guidelines without notice.

6. Prohibited Conduct

When using JourneyCatcher, you agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers connected to the Service
• Use bots, scrapers, or automated means to access the Service
• Spoof your location or manipulate GPS data to cheat in adventures
• Harass, bully, or intimidate other users
• Create multiple accounts to circumvent restrictions or bans
• Reverse engineer, decompile, or disassemble any part of the Service

7. Intellectual Property

The Service, including its original content (excluding User Content), features, and functionality, is owned by Journey Catcher ApS and is protected by international copyright, trademark, patent, and other intellectual property laws.

The JourneyCatcher name, logo, and all related names, logos, and slogans are trademarks of Journey Catcher ApS. You may not use these trademarks without our prior written permission.

8. Third-Party Services

The Service uses third-party services including:

• Google Maps: Map display and location services are provided by Google Maps, subject to Google Maps Terms of Service
• App Stores: Your use of the app is also subject to the terms of the Apple App Store or Google Play Store

We are not responsible for the content, privacy policies, or practices of any third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results from using the Service will be accurate or reliable
• Any errors in the Service will be corrected
• Adventures created by users are safe or suitable for all participants

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOURNEY CATCHER APS AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH:

• Your use or inability to use the Service
• Any conduct or content of any third party on the Service
• Any User Content obtained from the Service
• Unauthorized access, use, or alteration of your data
• Physical injury or property damage resulting from your use of the Service

In no event shall our total liability to you exceed the amount you have paid to us in the twelve (12) months preceding the claim, or €100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Journey Catcher ApS and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

12. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Upon account deletion, your personal information will be removed, but your published adventures will remain on the platform permanently as part of our content library.

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective Date." For significant changes, we may also provide notice through the app or via email. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved in the courts of Denmark. However, if you are a consumer residing in the European Union, you may also bring proceedings in your country of residence.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Journey Catcher ApS regarding the Service and supersede all prior agreements and understandings.
